AN ACT concerning

Department of Agriculture - Agricultural Liming Materials and Gypsum

FOR the purpose of requiring a distributor of agricultural liming materials and gypsum to
register certain information with the Secretary of Agriculture by a certain date;
altering certain fees; requiring certain information to be attached to or accompany
certain agricultural liming and gypsum materials; repealing obsolete language;
authorizing the Secretary of Agriculture to issue a stop-sale order for agricultural
liming material or gypsum under certain circumstances; making stylistic changes;
and generally relating to agricultural liming materials and gypsum.

Annotated Code of Maryland

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article - Agriculture

6-305.

(a)      [Every manufacturer or importer of each brand or trade name of agricultural
liming materials or gypsum, or both, who distributes agricultural liming materials or
gypsum shall register with the Secretary by February 1 of each year.] EXCEPT AS
PROVIDED IN SUBSECTION (C) OF THIS SECTION, A DISTRIBUTOR SHALL REGISTER
WITH THE SECRETARY BY FEBRUARY 1 OF EACH YEAR EACH BRAND OR TRADE
NAME OF AGRICULTURAL LIMING MATERIAL OR GYPSUM BEFORE DISTRIBUTING
THE LIMING MATERIAL OR GYPSUM IN THE STATE. The application for registration
shall be accompanied by a copy of the statement of the composition of the brands of the
materials AS required by § 6-307.

(b)     Each applicant for registration shall pay an annual [$110] $120 registration
fee for agricultural liming materials and gypsum sold or distributed in the State. In
addition, each registrant shall pay an inspection fee at the rate of [10] 15 cents per ton
sold in the State.

(c)      [If the registration and inspection fees for any brand of agricultural liming
materials or gypsum are paid by any other person, the distributor is not required to make
these payments.
