2. If a mutual or reciprocal insurer OR A NONPROFIT HEALTH
SERVICE PLAN, the minimum surplus required by this article to be maintained for the
kind or kinds of insurance business it is then authorized to transact; or
(ii) Has a financial inability as determined by the Commissioner to pay
any obligation within 30 days after it becomes due.
(2) (I) "Insurer" means any person, firm, corporation, association or
aggregation of persons who has done, purports to do, is doing, or is licensed to do an
insurance business, and is subject to the insurance supervisory authority of, or to
liquidation, rehabilitation, reorganization or conservation by the Commissioner or the
equivalent insurance supervisory official of another state.
(II) "INSURER" INCLUDES [An insurer shall also include a]:
1. A corporation operating a nonprofit health service plan
under Subtitle 20 of this article[,]; and
2. [any] ANY other person described in § 132A of this subtitle.

[(a)] Any corporation without capital stock heretofore or hereafter organized for
the purpose of establishing, maintaining and operating a nonprofit health service plan
whereby hospital, medical, chiropodial, chiropractic, pharmaceutical, dental,
psychological or optometric care is provided by a hospital, or hospitals, a physician or
physicians, a chiropodist or chiropodists, a chiropractor or chiropractors, a pharmacist or
pharmacists, a dentist or dentist's, a duly licensed psychologist or psychologists, or an
optometrist or optometrists, to persons who become subscribers to such plan under
contracts which entitle each subscriber to certain hospital, medical, chiropodial,
chiropractic, pharmaceutical, dental, psychological, or optometric care or any of them,
shall be governed and regulated by [the provisions of this subtitle, and of Subtitle 11 of
this article, and by no other law relating to insurance unless such law is referred to under
this subtitle, and no law hereafter enacted shall apply to such corporations, unless they
are expressly designated therein, and specifically refer to such corporations.
Notwithstanding this, the Commissioner shall have those powers and duties necessary to
enforce the provisions of this subtitle with respect to nonprofit health service plans as are
granted under §§ 24 and 25 of this article]:
(1) THE PROVISIONS OF THIS SUBTITLE;
(2) SUBTITLE 2 OF THIS ARTICLE;
(3) SUBTITLE 5 OF THIS ARTICLE;
(4) SUBTITLE 6 OF THIS ARTICLE;
(5) SUBTITLE 10 OF THIS ARTICLE;
(6) SUBTITLE 11 OF THIS ARTICLE;
(7) SUBTITLE 15 OF THIS ARTICLE;
