(2) The health maintenance organization may request and the health care
provider shall provide adjunct claims documentation to assist in making the
determination under paragraph (1) of this subsection or under subsection (b) of this
section.
(d) In addition to any other penalties under this subtitle, the Commissioner may
impose a penalty not to exceed $5,000 on any health maintenance organization which
violates the provisions of this section if the violation is committed with such frequency as
to indicate a general business practice of the health maintenance organization.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect
October 1, 1993. . .

AN ACT concerning
Minority Business Enterprise Program Participation - Reporting Requirements
FOR the purpose of requiring certain units of State government, when reporting certain,
information each year to the Governor's Office of Minority Affairs regarding
minority business enterprise participation during the previous fiscal year, to specify,
by category of minority business enterprise, the number, dollar value, and
percentage of such procurement contracts awarded in relation to the total number
and total value of procurement contracts awarded during that fiscal year; providing
a contingent codification; and generally relating to the reporting of certain
information to the Governor's Office of Minority Affairs regarding the award of
procurement contracts to minority business enterprises by certain units of State
government.
