of governmental regulatory or legislative policy or objectives of an association whose
memb
ers are regulated by the Board an officer, member of certain committees, or
member of the house of delegates of an association whose members are regulated
by the Board; and generally relating to the qualification of members of the State
Board of Dental Examiners.

BY repealing and reenacting, with amendments,
Article - Health Occupations
Section 4-202(c) and (d)
Annotated Code of Maryland
(1991 Replacement Volume and 1992 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article - Health Occupations

4-202.

(c)     Each dentist Board member:

(1)     Shall be an individual of recognized ability and honor;

(2)     Shall be a practicing holder of a general license to practice dentistry who
has practiced dentistry actively in this State for at least 5 years immediately before
appointment;

(3)     Shall be a resident of this State; [and]

(4)     May not be a member of a faculty or teaching staff of any college or
university in this State that offers undergraduate courses in dentistry; AND

(5)     MAY NOT BE AN OFFICER, MEMBER OF A GOVERNING BOARD OR
COMMITTEE, OR A VOTING MEMBER OF A COMMITTEE THAT CONTRIBUTES TO THE
ESTABLISHMENT OF GOVERNMENTAL REGULATORY OR LEGISLATIVE POLICY OF
OBJECTIVES OF AN ASSOCIATION WHOSE MEMBERS ARE REGULATED BY THE
BOARD.

(5) IN THE CASE OF A BOARD MEMBER BELONGING TO AN
ASSOCIATION WHOSE MEMBERS ARE REGULATED BY THE BOARD, MAY NOT BE:

(I)      AN OFFICER OF THE ASSOCIATION;

(II)     A MEMBER OF THE ASSOCIATION'S GOVERNING BOARD OR
COMMITTEE;

(III)   A MEMBER OF THE ASSOCIATION'S HOUSE OF DELEGATES; OR

(IV)   A VOTING MEMBER OF A COMMITTEE OF THE ASSOCIATION
THAT CONTRIBUTES TO THE ESTABLISHMENT OF GOVERNMENTAL, REGULATORY,
OR LEGISLATIVE POLICY OBJECTIVES OF THE ASSOCIATION.

(d)     Each dental hygienist Board member:
