SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1989.

(House Bill 491)

AN ACT concerning

Used Tires - Storage and Disposal - Used Tire
Cleanup and Recycling Fund

FOR the purpose of prohibiting the storage of used tires except
under certain circumstances; altering the definition of
"solid waste" to include used tires; defining a certain
term terms; requiring the disposal of used tires in a
certain facility facilities under certain circumstances;
authorizing the Secretary of Environment to take certain
action for the removal of used tires and other remedial
action under certain circumstances; creating a State Used
Tire Cleanup and Recycling Fund; providing financing for the
Fund; providing for the use of the Fund; providing for the
reimbursement of certain moneys expended from the Fund by
certain persons; requiring the Secretary to adopt certain
regulations; establishing certain procedures and criteria;
providing certain conditions for use of the Fund; requiring
the Office of Recycling to consult with certain person in
studying certain methods for the management and recycling of
used tires; making this Act an emergency measure; and
generally relating to the storage, disposal, cleanup, arid
recycling of used tires.

BY repealing and reenacting, with amendments,

BY adding to
