SUBJECT TO THE PROVISIONS OF THIS SECTION AND, OF § 4-307 OF
THIS SUBTITLE, THE BOARD MAY WAIVE ANY REQUIREMENT OF THIS
SUBTITLE FOR AN INDIVIDUAL WHO IS LICENSED TO PRACTICE BARBERING
IN ANOTHER STATE.
(B) CONDITIONS.
THE BOARD MAY GRANT A WAIVER UNDER THIS SECTION ONLY IF THE
APPLICANT:
(1) PAYS THE APPLICATION FEE REQUIRED UNDER § 4-304
OF THIS SUBTITLE; AND
(2) PROVIDES ADEQUATE EVIDENCE THAT THE APPLICANT:
(I) MEETS THE QUALIFICATIONS OTHERWISE REQUIRED
UNDER THIS SUBTITLE; AND
(II) BECAME LICENSED IN THE OTHER STATE AFTER
PASSING AN EXAMINATION AND MEETING QUALIFICATIONS, IN THAT OR ANY
OTHER STATE, THAT ARE AT LEAST EQUIVALENT TO THOSE REQUIRED IN
THIS STATE.
(C) RECIPROCITY.
THE BOARD MAY GRANT A WAIVER UNDER THIS SECTION ONLY IF THE
STATE IN WHICH THE APPLICANT IS LICENSED WAIVES THE EXAMINATION
AND QUALIFICATIONS OF LICENSEES OF THIS STATE TO A SIMILAR EXTENT
AS THIS STATE WAIVES THE EXAMINATION AND QUALIFICATION
REQUIREMENTS FOR INDIVIDUALS LICENSED IN THAT STATE.
REVISOR'S NOTE: This section is new language derived
without substantive change from former Art. 56, §
438(a). It is rephrased in the standard language now
used throughout the revised articles of the Code for
provisions that allow or require waiver of
qualifications.
The introductory language of subsection (a) of this
section, "[s]ubject to the provisions of this section
and of § 4-307 of this subtitle", is added as a
general reference to the conditions for waiver of
qualifications and to the specific conditions for
waiver of examination.
In subsection (b)(1) of this section, the reference to
an "application fee" is substituted for the former
reference to the "appropriate fee", for clarity.
In subsection (b)(2)(i) of this section, the reference
to "meet[ing] the qualifications otherwise required"
is added to provide that the equivalency of
requirements is to be determined at the time of
