(2) THE REGISTRATION SUBMISSION SHALL INCLUDE A
WRITTEN SUMMARY DESCRIPTION OF THE ARRANGEMENT, CONTRACTS, OR
AGREEMENTS ESTABLISHING THE PREFERRED PROVIDER ARRANGEMENT, AND
PROTOTYPE COPIES OF AGREEMENTS WITH PREFERRED PROVIDERS.
(3) EACH INSURER, NONPROFIT HEALTH SERVICE PLAN,
DENTAL PLAN ORGANIZATION, OR SIMILAR ORGANIZATION, AND EACH
EMPLOYER, ADMINISTRATOR, OR OTHER ENTITY ESTABLISHING A PREFERRED
PROVIDER ARRANGEMENT SHALL REGISTER SUBMIT THE ARRANGEMENT ON OR
BEFORE AUGUST 1, 1988, OR WITHIN 30 DAYS AFTER THE EFFECTIVE DATE
OF THE ARRANGEMENT, WHICHEVER IS LATER.
(C) EACH INSURER, NONPROFIT HEALTH SERVICE PLAN, DENTAL
PLAN ORGANIZATION, OR SIMILAR ORGANIZATION, AND EACH EMPLOYER,
ADMINISTRATOR, OTHER ENTITY ESTABLISHING A PREFERRED PROVIDER
ARRANGEMENT SHALL REGISTER SUBMIT ANY AMENDMENT OF A PREFERRED
PROVIDER ARRANGEMENT NOT LATER THAN 30 DAYS AFTER THE EFFECTIVE
DATE OF THE AMENDMENT.
(D) THE COMMISSIONER SHALL CHARGE AND COLLECT A FEE OF $10
$200 FOR EACH INITIAL REGISTRATION SUBMISSION OR AND $50 FOR EACH
SUBSEQUENT AMENDMENT OF A REGISTRATION SUBMISSION.
(E) (C) THE COMMISSIONER MAY IMPOSE A PENALTY OF NOT LESS
THAN $50 OR MORE THAN $1,000 FOR FAILURE TO REGISTER SUBMIT OR
FOR LATE REGISTRATION SUBMISSION COMPLY WITH THIS SECTION.
Article - Health - General
19-706.
(a) Each health maintenance organization that is issued a
certificate of authority by the Commissioner shall be regulated
under this subtitle.
(b) (1) Any health maintenance organization that is
regulated by Article 48A, Subtitle 20, Nonprofit Health Service
Plans, of the Code is subject also to this subtitle.
(2) This subsection applies to a corporation
described in Article 48A, Subtitle 20, Nonprofit Health Service
Plans, of the Code, but only if it is a health maintenance
organization.
(c) Except as otherwise provided in this subtitle, a health
maintenance organization is not subject to the insurance laws of
this State.
(D) THE PROVISIONS OF ARTICLE 48A, SUBTITLE 11 SHALL APPLY
TO HEALTH MAINTENANCE ORGANIZATIONS.
