VETOES
FOR the purpose of designating community action agencies and the
Tri-County Council of Southern Maryland as a municipal
corporation corporations for purposes of inclusion in the
State Employees' Retirement and Pension System; and defining
a certain term.
BY repealing and reenacting, with amendments,
Article 73B - Pensions

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:
Article 73B - Pensions
163.
(a) In this subtitle the following words have the meanings
indicated.
(b) "Employee", as used in this subtitle, means the
officers and employees of a municipal corporation who are
eligible to and who participate in the Employees Retirement
System of the State of Maryland or the Pension System for
Employees of the State of Maryland.
(c) (1) "Legislative body" means county commissioners, city
council, town council, president and commissioners, burgess and
commissioners (or by whatever other name the legislative body of
any incorporated town, city, or municipality may be known), and
the board or commission having authority or control over any
other political subdivision of the State, including the board or
governing body of any public library association or organization
and any fire department receiving part or all of its funds from
or through any county, incorporated town, or municipality, or
special taxing area, or other political subdivision of the State.
(2) FOR A COMMUNITY ACTION AGENCY, "LEGISLATIVE BODY"
SHALL BE THE GOVERNING BODY AS DEFINED IN ARTICLE 41, § 6-107 OF
THE CODE.
(d) (1) "Municipal corporation" means. a county,
incorporated town, or municipality or special taxing area, or any
other political subdivision of the State.
(2) "Municipal corporation" includes any public
library association or organization, any fire department that
receives part or all of its funds from or through any county,
town, municipality, special taxing area, or other political
