Comptroller shall consider whether a competent chemist using
modern analytical techniques could be reasonably expected to
identify the component.
(c) Every manufacturer, refiner, [or] SPECIAL FUEL SELLER
AND motor fuel wholesaler shall file all terminal agreements with
additive and refinery specifications for approval by the
Comptroller of the Treasury before any sales can be made.
(h) No motor fuel wholesaler, [diesel] SPECIAL fuel seller,
[heating oil distributor,] manufacturer, refiner, [jobber,]
common carrier, and contract carrier engaged in interstate and
intrastate transportation of gasoline and special fuels may
willfully adulterate or comingle any refined gasolines with other
[petroleum products] MOTOR VEHICLE FUEL. No common carrier or
contract carrier may place any additives in any gasoline or
special fuels. This subsection shall not preclude adulteration
or comingling of gasoline with other [petroleum products] MOTOR
VEHICLE FUEL which occurs as a natural cause of transit and as a
consequence of transit in pipeline carriers.

[Every person, firm or corporation delivering at wholesale
or retail any gasoline in this State, shall deliver the same to
the purchaser only in trucks, tank wagons, tractor trailers,
tanks, barrels, cans, motor vessel, barge, tank car, aircraft or
other containers having the words "gasoline" and "flammable"
plainly stenciled or labeled thereon. Except for underground
tanks, every purchaser of gasoline for use or sale shall procure
and keep the same only in tanks, barrels, cans or other
containers having the word "gasoline" stenciled or labeled
thereon.
Every person, firm or corporation delivering at wholesale or
retail any special fuels in this State shall deliver same to
purchaser only in trucks, tank wagons, tractor trailer, tanks,
barrels, cans, motor vessel, barge, tank car, aircraft or other
containers having the word "kerosene," "heating oil" or "diesel
oil" plainly stenciled or labeled thereon and every person
purchasing same for use or sale shall procure and keep the same
in tanks, barrels, cans or other containers stenciled or labeled
as heretofore provided, except that this provision shall not
apply to underground tanks.
Nothing in this section shall prohibit the delivery by pump
of gasoline and special fuels into the tank of any automobile or
other motor vehicle.]
In the event that a truck, tank wagon, tractor trailer,
tank, barrel, can or other container is used for the delivery of
both gasoline and special fuels all traces of gasoline must be
removed before a delivery of special fuels can be made at
wholesale or retail.
