AN ACT concerning
Group Health Insurance - Coverage of Divorced Spouses
FOR the purpose of requiring group health insurance coverage to
be provided to certain divorced spouses and dependent
children; setting forth limitations on eligibility for
coverage; requiring the employed spouse to pay the entire
cost of coverage for the divorced spouse and dependent
children; requiring that the health insurance offered
coverage required by this Act be identical to coverage
offered to spouse's spouses who have not been divorced and
their dependent children; requiring certificates issued
under group insurance contract contracts to specify the
availability, eligibility, and duration of the health
insurance coverage; limiting liability the of the insurer
and employer in certain cases; specifying that the coverage
required by this Act does not limit or affect conversion
rights; providing that the obligations of the employed
spouse are subject to modification or nullification
additional costs associated with the coverage may be
allocated between the employed spouse and the divorced
spouse, by agreement or by the court; requiring the Insurance
Commissioner to publish certain notices and provide certain
forms; modifying other provisions regarding continuation of
health benefits; making health maintenance organizations
subject to this Act defining certain terms; providing for
the applicability of this Act; providing for a delayed
effective date; and generally relating to group health
insurance coverage.
