SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article - Natural Resources

4-1001.

(a) In this subtitle, the following words have the meanings
indicated.

(q) "Soft-shell clams" means mollusks of the species:

(1)  mya [mya] MYA arenaria; AND

(2)  GENUS TAGELUS WHEN HARVESTED FOR HUMAN

CONSUMPTION.

4-1033.

(D) (1) THE DEPARTMENT SHALL ESTABLISH A SPECIFIC LIMIT ON
THE NUMBER OF BUSHELS OF RAZOR CLAMS (GENUS TAGELUS) THAT A
PERSON MAY TAKE FROM THE WATERS OF THE STATE IS 100 BUSHELS PER
DAY.

(2) NOTWITHSTANDING THE PROVISIONS OF § 4-1040.1 OF
THIS SUBTITLE, THE DEPARTMENT SHALL PERMIT THE TAKING OF RAZOR
CLAMS (GENUS TAGELUS) AFTER 1 P.M. AND WITHOUT ON-BOARD
REFRIGERATION IF:

(I) THE CLAMS ARE TAKEN FOR OTHER THAN HUMAN
CONSUMPTION; AND
