   of Tobacco Damages on Account of the Said Deft his not performing his promise &
   assumption afd Sustained and also the Sume of Three hundred thirty nine pounds of Tobacco
   Cost by the Said Plt about his Suite in this behalfe expended and by the Court here
   of his Assent adjudged And that the Said Deft. be taken into Custody —
   Wm Burk being Sumd as Evid.e in the above Cause at ye Suite of ye Plt . }
   this Court orders that the Sd Wm be paid thirty pds of Tobo for his - } Jams Smith Clk
   attendance as an Evid.e as afd it being one day & y.t ye Same be put in the Bill of Cost~ ——
   John Green   . | Decln plea the plt by Thomas Bowne his attry prays that
        at | rule may given to the afd Deft to plead . This Court gives rule
   Philip Pearse | to ye Deft to plead Tomorrow But the Said Deft pray that he


may have liberty to Amend his plea in ye Said Accon And that -
   the Court will tax him Cost. This Court Taxes Cost for the Deft to pay to the Plt the
   Sume of thirty pounds of Tobacco and to Come to Tryal in ye Same Accõn &ca —
   Francis Cooke & John | This being an Accõn of Trespass^onye Case Standing on ye.
   Johnson | tryal Dockett Came the Said Plts in there proper —
             at | persons and Discontinues the afd Accõn & that all—
