Health and Mental Hygiene; providing for certain penalties;
providing that the Department of Health and Mental Hygiene
shall report annually to the General Assembly; providing
that, in the event of a certain occurrence, this Act shall
be of no force and effect; providing that if the provisions
of this Act are found to be of no force and effect then the
General Assembly should take appropriate action; providing
for a delayed effective date; and generally relating to the
certificate of need requirement for licensing of certain
medical equipment.
FOR the purpose of reducing the long term costs of health care by
requiring a license before certain medical equipment may be
leased, acquired, or used by certain health care
professionals or private entities providing health care
services; repealing certain provisions of law relating to
the certificate of need process; exempting from certain
provisions of law a certain change in health care services,
the acquisition of certain business and office equipment,
and the making of certain capital expenditures; making
technical changes; defining certain terms; requiring the
Secretary of Health and Mental Hygiene to adopt certain
regulations concerning the licensing of major medical
equipment; providing for licensing procedures____and
requirements; providing for a certain exception to the
licensing requirements of this Act; providing that the
Secretary may consult with the Health Resources Planning
Commission before issuing a license; providing for the
renewal of the license; providing for license application
and license renewal fees; exempting certain equipment from
the requirements for payment of fees; providing for the
denial or revocation of a license under certain
circumstances; providing for notice and an opportunity to be
heard before certain actions are taken by the Secretary of
Health and Mental Hygiene; providing for certain penalties;
providing that, in the event of a certain occurrence,
certain parts of this Act shall be of no force and effect;
providing for certain reporting requirements; providing for
the termination of certain provisions of this Act; providing
for a delayed effective date; and generally relating to the
licensing of certain medical equipment.
