AN ACT concerning
Food Products - Sale By Weight - Exceptions
FOR the purpose of allowing the Secretary of Agriculture to
specify whether certain meat, poultry, or seafood products
are offered or exposed for sale or sold by weight; revising
and restating certain exceptions to the requirement that
certain products only be offered or exposed for sale or sold
by weight; excluding condiments from certain provisions of
this Act; allowing certain chicken parts to be sold by
weight, measure, or count; and generally providing for
offering or exposing for sale or selling certain meat,
poultry, or seafood products by weight, measure, or count.
BY repealing and reenacting, with amendments,

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

11-311.
(a) (1) EXCEPT AS PROVIDED IN THIS SUBSECTION OR AS
SPECIFIED BY THE SECRETARY, [Any] ANY meat, meat product,
poultry, and all seafood offered or exposed for sale or sold as
food shall be offered or exposed for sale and sold by weight[,
unless it is for immediate consumption on the premises where
sold, it is one of several elements comprising a ready-to-eat
meal as a unit for consumption elsewhere than on the premises, or
it is shellfish].
(2) NOTWITHSTANDING THE PROVISIONS OF PARAGRAPH (1)
OF THIS SUBSECTION, THE FOLLOWING PRODUCTS MAY BE OFFERED OR
EXPOSED FOR SALE OR SOLD BY WEIGHT, MEASURE, OR COUNT:
(I) SHELLFISH;
