Preamble
WHEREAS, The citizens of this State have voiced their
concern over the land disposal of controlled hazardous
substances;
WHEREAS, The U.S. Environmental Protection Agency has stated
that 90 percent of the hazardous wastes annually generated in the
United States can be disposed of safely without landfilling;
WHEREAS, The Department of Health and Mental Hygiene
considers certain criteria when deciding which controlled
hazardous substance may not be landfilled;
WHEREAS, Safe and effective technologies such as source
reduction, reuse or recycling, incineration, treatment, and other
methods exist for most controlled hazardous substances to replace
landfilling; now, therefore,
SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

(A) THIS SECTION DOES NOT APPLY TO HAWKINS POINT CONTROLLED
HAZARDOUS SUBSTANCE LANDFILL.
(B) AFTER JUNE 30, 1984, THE DEPARTMENT MAY NOT ISSUE ANY
PERMIT FOR THE SITING OR OPERATION OF A CONTROLLED HAZARDOUS
SUBSTANCE LANDFILL UNTIL THE DEPARTMENT OR THE FEDERAL
ENVIRONMENTAL PROTECTION AGENCY ADOPTS BY REGULATIONS A LIST
DESIGNATING THOSE SUBSTANCES WHICH MAY NOT BE PLACED IN A
LANDFILL.
