(b) [(1)] A person shall be licensed by the Department
before the person may catch oysters with a power dredge in the
waters of the State that lie contiguous to Somerset County, as
described in subsection (a) of this section.
[(2) The fee for a power dredging license is $50,
which is a separate license in addition to an oyster harvester
license.]
SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1984.

AN ACT concerning
Appropriation of and Construction in State Waters - Permits
FOR the purpose of establishing that the terms and conditions of
a permit to appropriate or use waters of the State or to
construct, reconstruct, repair, or change, any dam,
reservoir, waterway obstruction, or change in the course,
current, or cross section of any stream, are binding on the
owner of the land or facility covered by the permit as well
as any heirs, successors, or assigns; and authorizing
requiring the Department of Natural Resources to require the
owner owners of certain types of permitted facilities to
record a certain memorandum among the land records of each
county in which the land or facility under permit is located
at the owner's expense.
