(2) If any THE appropriation to support the
Corporation is made, it shall be in the State operating budget
that is submitted to the General Assembly in the third week of
January each year, or in any supplement to that State budget.

(B) IN ADDITION TO ANY BUDGET APPROPRIATION, THE GOVERNOR,
WITH THE APPROVAL OF THE BOARD OF PUBLIC WORKS, SHALL TRANSFER
$1,000,000 TO THE CORPORATION ON JULY 1 OF EACH YEAR FROM THE
ABANDONED PROPERTY SPECIAL FUND, ESTABLISHED UNDER § 17-317 OF
THE COMMERCIAL LAW ARTICLE; AS FOLLOWS:

(1) AN ANNUAL DEDUCTION OF $500,000 FROM THE

ABANDONED PROPERTY FUNDS ALLOCATED TO THE COUNTIES UNDER § 17-317
OF THE COMMERCIAL LAW ARTICLE; AND

(2) AN ANNUAL DEDUCTION OF $500,000 FROM THE

ABANDONED PROPERTY FUNDS DEPOSITED IN THE GENERAL FUNDS OF THE
STATE UNDER § 17-317 OF THE COMMERCIAL LAW ARTICLE.

(B) (1) TO SUPPORT THE APPROPRIATION IN SUBSECTION (A) (1)
OF THIS SECTION OR IN ADDITION TO ANY APPROPRIATION IN SUBSECTION
(A) (1) OF THIS SECTION, THE GOVERNOR MAY TRANSFER TO THE
CORPORATION UP TO $500,000 ON JULY 1 OF EACH YEAR FROM THE
PORTION OF ABANDONED PROPERTY FUNDS DEPOSITED IN THE GENERAL
FUNDS OF THE STATE UNDER § 17-317 OF THE COMMERCIAL LAW ARTICLE.

(2) TO THE EXTENT THAT THE BALANCE IN THE PORTION OF
ABANDONED PROPERTY FUNDS DEPOSITED IN THE GENERAL FUNDS OF THE
STATE UNDER § 17-317 OF THE COMMERCIAL LAW ARTICLE, AFTER
DEDUCTING ALL COSTS OF ADMINISTERING THE FUND, IS LESS THAN
$500,000, THEN ONLY THE BALANCE MAY BE TRANSFERRED IN ACCORDANCE
WITH SUBSECTION (B) (1) OF THIS SECTION.

(C) THE BOARD SHALL USE ALL APPROPRIATED FUNDS SOLELY FOR
THE FUNDING OF THE CORPORATION'S LEGAL ASSISTANCE PROGRAMS. "NO
APPROPRIATED FUNDS MAY BE USED FOR THE CORPORATION'S
ADMINISTRATIVE EXPENSES.

[(b)] (C) (D) Nonstate funds received by the Corporation
shall be accounted for and reported as receipts and disbursements
separate and distinct from State funds.

Article - Commercial Law

17-317.

(a) (1) All funds received under this title, including the
proceeds of the sale of abandoned property under § 17-316 of this
subtitle, shall be credited by the administrator to a special
fund. The administrator shall retain in the special fund at the
end of each fiscal year, from the proceeds received, an amount
not to exceed $50,000, from which sum the administrator shall pay
any claim allowed under this title.
