HARRY HUGHES, Governor

SECTION 3. AND BE IT FURTHER ENACTED, That Section 1 of
this Act shall take effect July 1, 1984 and shall be void and of
no effect after September 30, 1984.

SECTION 4. AND BE IT FURTHER ENACTED, That Section 2 of
this Act shall take effect October 1, 1984.

(House Bill 697)

AN ACT concerning

State Employees - Health Insurance Program - Open Enrollment -
Nonparticipating Surviving Spouses

FOR the purpose of requiring that the State Employees' Health
Insurance Program provide continuous open enrollment for
nonparticipating State employees under certain
circumstances; providing that evidence of insurability may
not be required if the State employee was previously covered
under another group health insurance policy; and generally
relating to the State Employees' Health Insurance Program.

Section 48B

Annotated Code of Maryland
(1983 Replacement Volume)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article 64A - Merit System

48B.

(A) THE STATE EMPLOYEES' HEALTH INSURANCE PROGRAM SHALL
PROVIDE CONTINUOUS OPEN ENROLLMENT FOR ANY NONPARTICIPATING STATE
EMPLOYEE WHO IS THE SURVIVING SPOUSE OF AN INDIVIDUAL WHO WAS NOT
A STATE EMPLOYEE.

(B) EVIDENCE OF INSURABILITY MAY NOT BE REQUIRED IF THE
SURVIVING SPOUSE WAS PREVIOUSLY COVERED UNDER A GROUP HEALTH
INSURANCE POLICY.
