agency, or a nonprofit corporation organized for the purpose of
constructing or acquiring such a hospital, related institution or
combination of a hospital and a related institution.

(2)   "Hospital" includes:

(i) Nonprofit comprehensive health centers
providing out-patient primary health services available to the
general public, but does not include any facility as described in
this paragraph which is owned and operated by the State, except
that with the approval of the Board of Public Works and the Joint
Budget and Audit Committee of the General Assembly the term
includes medical or health care facilities of the University of
Maryland;

(ii) Nonprofit life care or continuing care
communities providing self-contained residence facilities for the
retired or elderly, but does not include any facility as
described in this sentence which is owned and operated by the
State unless approved by the Board of Public Works and the Joint
Budget and Audit Committee of the General Assembly; and

(iii) Any combination of any of the facilities
and centers enumerated in subparagraphs (i) and (ii) of this §
3(h)(2).

(3)  FACILITIES OF THE UNIVERSITY OF MARYLAND MEDICAL
SYSTEM CORPORATION SHALL NOT BE DEEMED TO BE OWNED AND OPERATED
BY THE STATE.

SECTION 2. AND BE IT FURTHER ENACTED, That until such time
as the board of directors and board of regents provide a
different procedure for the approval of the annual contract, the
annual contract shall be approved as provided in this section.
Subsequent to the chancellor's approval of the annual contract,
it shall be presented to a committee appointed from the board of
regents and the board of directors. This committee will consider
the annual contract, make any amendments it deems appropriate and
recommend ratification. The committee shall have 6 members.
Three committee members must be members of the board of regents
and shall be selected by the chairman of the board of regents.
The other 3 members must be members of the board of directors who
are not also members of the board of regents and shall be
selected by the chairman of the board of directors. The
committee shall elect its chairman annually. The chairmanship
must alternate between a member of the board of regents and a
member of the board of directors not also a member of the board
of regents. The first chairman shall be a member of the board
of regents.

SECTION 3. AND BE IT FURTHER ENACTED, That for each fiscal
year there shall be calculated the pension costs for all medical
system university personnel and this cost then compared to the
