(I) (K) THE BOARD OF DIRECTORS MAY ESTABLISH NONPROFIT OR
FOR-PROFIT SUBSIDIARIES OR RELATED ENTITIES TO THE EXTENT
APPROVED BY THE UNIVERSITY IN THE ANNUAL CONTRACT.

(L)  THE BOARD OF DIRECTORS SHALL INSURE THAT THE MEDICAL
SYSTEM SHALL MAKE AVAILABLE MEDICAL SERVICES TO RESIDENTS OF
VARIOUS STATE INSTITUTIONS WHOSE RESIDENTS ARE SERVED BY THE
HOSPITAL ON JUNE 1, 1984, INCLUDING STATE RESIDENTIAL CENTERS FOR
THE MENTALLY RETARDED, MENTAL HYGIENE STATE FACILITIES AND
FACILITIES RUN BY THE DIVISION OF CORRECTIONS, AS LONG AS THE
ADMINISTRATORS OF THOSE INSTITUTIONS CONTINUE TO SEEK CARE FROM
THE HOSPITAL FOR THEIR RESIDENTS IN ACCORDANCE WITH POLICIES AND

LEGISLATIVE INTENT INCORPORATED IN THE STATE BUDGET. THE

HOSPITAL IS TO BE COMPENSATED BY THE INSTITUTIONS OR OTHER PAYORS
FOR THIS CARE IN ACCORDANCE WITH POLICIES OF THE STATE HEALTH
SERVICES COST REVIEW COMMISSION OR OTHER APPLICABLE REGULATORY
AUTHORITY.

(L) THE BOARD OF DIRECTORS SHALL INSURE THAT THE MEDICAL
SYSTEM SHALL CONTINUE TO MAKE AVAILABLE MEDICAL SERVICES TO
RESIDENTS OF VARIOUS STATE INSTITUTIONS WHOSE RESIDENTS PRIOR TO
THE EFFECTIVE DATE OF THIS LEGISLATION WERE SERVED BY THE
HOSPITAL, INCLUDING STATE RESIDENTIAL CENTERS FOR THE MENTALLY
RETARDED, STATE MENTAL HYGIENE FACILITIES AND FACILITIES RUN BY
THE STATE DIVISION OF CORRECTIONS, AS LONG AS THE ADMINISTRATORS
OF THOSE INSTITUTIONS CONTINUE TO SEEK CARE FROM THE HOSPITAL FOR
THEIR RESIDENTS IN ACCORDANCE WITH POLICIES AND LEGISLATIVE
INTENT INCORPORATED IN THE STATE BUDGET. THE HOSPITAL IS TO BE
COMPENSATED BY THE INSTITUTIONS OR OTHER PAYORS FOR THIS CARE IN
ACCORDANCE WITH POLICIES OF THE STATE HEALTH SERVICES COST REVIEW
COMMISSION OR OTHER RELEVANT AUTHORITY.

13-1B-04.

(A)  THE GOVERNMENT OF THE MEDICAL SYSTEM CORPORATION IS
VESTED IN THE BOARD OF DIRECTORS.

(B)  THE BOARD OF DIRECTORS CONSISTS OF 6 7 NONVOTING
MEMBERS AND 25 17 21 VOTING MEMBERS APPOINTED BY THE GOVERNOR.

(C)  (1) EACH MEMBER SHALL BE A RESIDENT OF THIS STATE.

(2)  FIVE THREE VOTING MEMBERS SHALL BE MEMBERS OF THE
BOARD OF REGENTS.

(3)  FOUR TWO VOTING MEMBERS SHALL BE MEMBERS OF THE
GENERAL ASSEMBLY, 2 1 NOMINATED BY THE PRESIDENT OF THE SENATE
AND 2 1 NOMINATED BY THE SPEAKER OF THE HOUSE OF DELEGATES.

(4) ONE VOTING MEMBER OF THE BOARD OF DIRECTORS SHALL
BE SELECTED BY THE COMMUNITY ADVISORY COUNCIL FROM THE MEMBERSHIP
OF THE COMMUNITY ADVISORY COUNCIL.
