14-602. (A) (1) NOTWITHSTANDING ANY OTHER PROVISION OF LAW, A PROCUREMENT CONTRACT SHALL HAVE A STATEWIDE PARTICIPATION GOAL OF NOT
LESS THAN 3% FOR DISABLED VETERAN BUSINESS ENTERPRISES.
(2) IN ACCORDANCE WITH PARAGRAPH (1) OF THIS SUBSECTION, A
PARTICIPATION COAL OF NOT LESS THAN 3% FOR DISABLED VETERAN BUSINESS
ENTERPRISES SHALL APPLY TO THE OVERALL DOLLAR AMOUNT EXPENDED
ANNUALLY BY EACH AWARDING UNIT.
(B) EACH YEAR THE HEAD OF EACH AWARDING UNIT, JOINTLY WITH THE
DEPARTMENT OF VETERANS AFFAIRS, SHALL ESTABLISH A PARTICIPATION GOAL OF
NOT LESS THAN 3% FOR DISABLED VETERANS THAT REFLECTS THE POTENTIAL OF
DISABLED VETERAN BUSINESS ENTERPRISES TO PERFORM CONTRACTS AND
SUBCONTRACTS AND MAKES EFFORTS TO EXPAND PARTICIPATION BY DISABLED
VETERAN BUSINESS ENTERPRISES.
14-603. (A) TO ACHIEVE THE RESULT SPECIFIED IN § 14-602 OF THIS SUBTITLE, AN
AWARDING UNIT SHALL CONSIDER THE EFFORTS OF A RESPONSIBLE BIDDER OR
RESPONSIBLE OFFEROR TO MEET DISABLED VETERAN BUSINESS ENTERPRISE
GOALS AND AWARD THE PROCUREMENT CONTRACT TO THE LOWEST RESPONSIBLE
BIDDER OR RESPONSIBLE OFFEROR MEETING OR MAKING GOOD FAITH EFFORTS TO
MEET THESE GOALS.
(B) A BIDDER OR OFFEROR SHALL BE CONSIDERED TO HAVE MADE A GOOD
FAITH EFFORT TO COMPLY WITH SUBSECTION (A) OF THIS SECTION ON SUBMITTAL,
WITHIN TIME LIMITS SPECIFIED BY THE AWARDING DEPARTMENT, OF

DOCUMENTARY EVIDENCE THAT ALL OF THE FOLLOWING ACTIONS WERE TAKEN: (1) CONTACT WAS MADE WITH THE AWARDING UNIT TO IDENTIFY
DISABLED VETERAN BUSINESS ENTERPRISES;
(2) CONTACT WAS MADE WITH OTHER STATE AND FEDERAL AGENCIES
AND DISABLED VETERAN BUSINESS ENTERPRISE ORGANIZATIONS TO IDENTIFY
DISABLED VETERAN BUSINESS ENTERPRISES;
(3) ADVERTISING WAS PUBLISHED IN TRADE PAPERS AND PAPERS
FOCUSING ON DISABLED VETERAN BUSINESS ENTERPRISES, UNLESS TIME LIMITS
IMPOSED BY THE AWARDING UNIT DO NOT PERMIT THAT ADVERTISING;
(4) NOTICES OF INVITATIONS FOR BIDS OR REQUESTS FOR PROPOSALS
WERE PROVIDED TO POTENTIAL DISABLED VETERAN BUSINESS ENTERPRISE
CONTRACTORS; AND
(5) AVAILABLE DISABLED VETERAN BUSINESS ENTERPRISES WERE
CONSIDERED.
