(659 Anne by the Grace of God of Great Britaine France and Ireland Queen defender of the Faith &c.a Whereas James Heath of Ann Arundell County hath lately Exhibited his Bill of Complaint in our high Court of Chancery before our Trusty and well beloved John Seymour Esq.r our late Cap.t Grabb Govern.r and Keeper of our Great Seale of our Province of Maryland against James Neale of Charles County Gent Jeremiah Adderton of Saint Maryes County Gent & Mary his Wife daughter to the said James whereby he has sett forth that upon the 10.th day of Aprill 1702 the said James Neale of Charles County as aforesaid Gent and Eliz his wife by their Deed Indented and inrolled according to Act of Assembly of this Province did bargaine sell Convey as afores.d and make over unto a certaine Charles Edgerton and inrolled according to Act of Assembly of this Province did bargaine sell Convey late of the County of Saint Maryes Deceased for the Considerations in the said Deed Exprest a certaine Tract of Land lyeing at a place called Piscattoway in Prince Georges County afs.d containeing six hundred Acres more or less being part of a Tract of three Thousand Acres heretofore (viz.t) upon the 11 day of February in the Yeare of our Lord 1662 granted in usall forme to William Calvert then of Saint Maries County deceased that upon the 15.th day of January 1703 the said Charles Edgerton and Mary his Wife by there Deed Indented inrolled and acknowledged according to law did for the Consideration therein Exprest bargaine sell Convey and firmly make over unto the said James Heath and his heire with Generall Warranty the aforesaid six hundred Acres of Land that the said James Heath upon strict Examination could not find how the afores.d James Neale and Elizabeth his wife became sized of Good firme and absolute Estate in fee simple in the said Six hundred Acres nor how they drove such Estate from the s.d William Calvert the Originall Pattented but has heard it alleadged that the said Elizabeth Neale being his daughter he gave the same in franke Marriage to the said James Neale upon his intermarriage with but the said James Heath Heath haveing upon dilligent search |
