(655 He the said Dep.t did see a White Oake bounded with about sixteene Notches and this Dep.t then Enquireing what Markt Tree that should be the said Hooton Answered this Dep.t sayd it was Robert Harwoods first bounded Tree of his Land Coole Spring Maryland fs.t Dorchester County November 16.th 1709 By Virtue of a Comission obtained by the Honoble Thomas Ennalls Esq.r out of the high Court of Chancery to us the Subscribed directed bearing date the second day of September Anno Domini 1709 Wee in humble manner Certifie that they day and Yeare abovesaid personally appeared before Us William Smith of the said County planter aged about forty Two Yeares or thereabouts who being by Us upon the holy Evangelist Sworne upon his Oath doth say that about three Yeares since being in Company with Phillips Shapley and severall other people upon a point of Land near the Mouth of Transquaking River a little below the Landing place of a certaine Richard Meares the said Shapley then shewed him and the rest of the Company the place where a Bounded Tree of a Tract of Land called Phillips Borough formerly stood w.ch is about a hundred Yards below the said Landing and further this Deponent saith That the said Phillip Shapley then made Oath before the said Thomas Ennalls that the said bounded Tree did stand near the said place the Copy of w.ch Deposition is hereunto annexed w.ch this Deponent saith he veryly beleives is the same Deposition that was then taken And further saith not Maryland fs.t To all Xpian People to whome these p.rsent shall Come Know yee that this day to with the 7.th day of Octob.r 1706 M.r Phillip Shapley of Northumberland County in the Colony of Virginia aged Sixty One Yeares or thereabouts did sware before me Thomas Ennalls one of her Majestys Councill on the holy Evangelist that about thirty ^six^ Yeares since he the said Dep.t was Deputy Surveyor of Dorchester County in this province and that he did survey some time in the Yeare of our Lord 1670 for the honoble Phillip Calvert a certaine Tract of Land called the Mannor of Phillips Borough Scituate and lyeing on the South side of Transquaking then called Chicocomoco or Phillips Creek And further the Dep.t doth sware that the begining of the said Land was at a Marked White Oake the w.ch Tree did stand about One hundred Yards below the Landing of one Richard Meares by the Mack side w.ch is the first Landing on the South side of the said Creeke from the Month thereof and further saith not Phillip Shapleigh Jurat Coram me Tho Ennalls |
