630) Further Saith that he had not a boat belonging to the said Sloope neither did he undertake To find any the Cap.t that last had her found her a boat And the Complt had her on the same Termes The Defendant further said that true it was the Sloope had lost her Anchor and beleives it was in the Service of the Shipp which last had her And as the Defend.t was informed the Complt borrowed an Anchor or Graplin for her before he meddled with her soe that then the Complt retd the sd Sloope as fitt and sufficient for his service And as the Defendant was informed landed her with salt &c Almost as deepe as She could Swimm and Transported the same from Miles river over to Kent Island where laying her a ground (as the Defend.t was informed by some of the men that belonged to her) At high water when the Tyde fell from her beleived She might be Injured and if any Damage happened beleive it to be after that Altho the Complt never before this pretended to have susteyned any Damage the Defendant knew of but that in the Tripp they broake of the Sloopes Rudder And the Defend.t beleives was done when they laid the Sloope on ground the truth whereof Cannot discover (The Complt as the Defendant hath heard) haveing threatned the men that went in her that if they said or gave any Evidence against him the Complt upon Tryall to his Damage he would make them answer for the same And the said Defend.t further sayes that he beleived they did carry the sd Sloope back from Kent Island to Wye river But as the defendant heard the Complts men left him and could not pceed any further with him Alleadging that the Complt was a very dissatisfyd man Soe that the Vessell lay some time before the Defendant heard any thing of her being there At length the Complt and Defendant mett at Williamstadt some discourse was moved About the Sloope betweene them and the Complt was very pressing to have the Defd.t to receive her where She then lay And be at the Charge of sending for her home The which to doe the Defendant denyed selling the Complt that he was obliged to bring her home at last the Complt Condesended thereto but Alleadged he could not gett hands Capable a person sitting by tole the Complt if he would well Assure him of his Wages before hand he would fetch her to the Defd.t but they did not agree upon the same for what reason the Defendant Could not remember Soe that the Complt not sending home the sd Sloope to the Defd.t he Commenced his Accon at Common law against the Complt but the Defendants Attorney |
