547 Governour of this province and the other third part thereof to John Danzey Collector of her Matys Customes of Potomock District To the 4.th That the said Ship was appraised to Three hundred Thirty Seven Eleven shillings & four pence with all her Gunns &c To y.e 5.th That S.r John Rogers Barronett of Plymouth in the Kingdom of England Merch.t was sole Owner of the s.d ship and a certain Abraham Peters Ma.r before the s.d Condemnacon To y.e 6.th That the s.d John Danzey the Defend.t did by Order of the Court of Admirallty (to witt) the 20.th of November or thereabouts undertake the Sale and disposall of the s.d ship Rogers together with her Gunns Tackle &c To y.e 7.th That Stephen Harvey then the Factor and Agent of the s.d S.r John Rogers did purchase the s.d ship with her Gunns Tackle Apparrell and Furniture for the sum of One hundred Ninety Seven pounds Nineteen shillings & Eleven pence for the s.d S.r John Rogers To y.e 8.th That there were Bills of Excha drawn for the afores.d sum by the said Harvey but as to their being seperate and distinct and to whom payable this Deponant knows not To y.e 9.th That the s.d Bills of Exch were delivered to the s.d John Dansey in full Satisfaction for the said Ship on behalf of the s.d S.r John Rogers To y.e 10.th That the s.d John Dansey did accept & negotiate the s.d Bills of Exchange To y.e 11.th That the s.d S.r John Rogers did write a Letter to the Deponant that the said Bills were by him paid to w.ch Letter he referreth himself To y.e 12.th That the s.d Dansey did permit the s.d Peters as Ma.r of the s.d Ship Rogers to load the same upon his Receiving the s.d Bills of Exch.a as he the said Danseys being then Collector of her Maty's Customs for Potomock District To y.e 13.th That the s.d Peters did load the s.d Ship with Three hundred and thirty seven hogsheads of Tobacco by vertue of the Authority & permission he had from the s.d Dansey Collector as afd and Coll.o Richard Lee Collector in Virginia To y.e 14.th That the s.d Peters did repair to the house of the s.d John Dansey the 14.th of July 1703 and the 20.th Instant following at his Office as Ma.r of the s.d ship Rogers to Clear the same in order to joyne the Convoy there ready to saile (viz.t) the Falmouth & York Two of her Majestys ships of War To y.e 15.th That the s.d ships of Warr were then in Virginia and Ordered to Convoy to England all such Ships as were then in Virginia & Maryland and ready to saile To y.e 16.th That the s.d Dansey upon Application made to him by the s.d Peters to Clear the said ship did promise to Clear the same provided the s.d Peters would meet him at his Office then kept at Tower Hill near Piney Point (and |
