385) Court as y.e Goods of Charles Partis decd whose Attorney y.e said James sometime had been And this Cause being this 30.th day of August Anno Dom.i 1698 before y.e s.d Court of Chancery heard & examined y.e s.d Complts bill & y.e Defts Answer & y.e Replication thereunto being read It is y.e opinion of this Court That the Compl.t had not in his hands any of y.e Goods of Charles Partis decd And y.t y.e s.d Tobacco so attached & condemned as afd was the proper Goods of y.e s.d Complt and y.t y.e s.d Charles Partis decd was really indebted to this Complt as in his s.d bill is alledged And therefore doth this Court order & Decree That y.e s.d Defts not not proceed any farther at Law ag.st y.e s.d Complt in this matter Nor taken from y.e s.d Complt any part of y.e afd attached & condemned tob And y.t y.e s.d Complt be relieved wholly against y.e s.d Judgment of y.e pvinciall Court as in his bill is Desired And y.t y.e said Complainant shall be reimbursed & repaid (by & from y.e Defts Sam.ll Houldworth & Hellen his Wife Exec.rx as aforesaid) all his reasonable Cause & charges in this behalf laid out & expended both at Law & equity Costs at Comon Law pticulars filed in y.e bill Costs in Chancery are as followeth viz |
