306) 1695 River in Dorchester County afd whose Lines are in y.e s.d bill expressed Containing & laid out for three hundred Acres more or less And y.t y.e s.d John Rawlins y.e Father did in his life time to wit about y.e year of our Lord 1680 for y.e Consideration of ten thousand pounds of tob to him y.e s.d John Rawlins well & truly paid by y.e s.d John Anderson y.e Complt agree to sell & convey y.e said 300 Acres called The Inheritance to y.e s.d Complt his heirs & assignes forever And also y.t he y.e s.d John Rawlins would in some short time after by himself or his Attorney thereunto authorized & appointed make to y.e s.d Complt a firm Conveyance of y.e s.d according to Law to be acknowledged & Recorded in y.e s.d County Court of Dorchester County afd but that before y.e s.d Conveyance was perfected he y.e s.d John Rawlins died leaving John Rawlins his son & heir an Infant under y.e age of 21 years By reason whereof y.e s.d Complt could not have a good estate made to him of y.e s.d 300 Acres of land till y.e s.d John Rawlins y.e son should be of fill age And whereas y.e s.d John Rawlins y.e son being satisfied y.t y.e s.d Complt had bought & paid for y.e s.d Land did therefore assure y.e s.d Complt & his heirs forever as afd And whereas y.e s.d John Rawlins being since arrived to full age hath been requested by y.e Complt to seal & execute a good & legall Conveyance of y.e s.d land to y.e s.d Complt and doth not absolutely deny to do y.e same but is willing to do it y.e s.d Complaint & his heirs forever provided he may be saved harmless from his Fathers Credit.rs And forasmuch as y.e s.d Complt hath therefore prayed for y.e Decree of this Hon.ble Court to force y.e s.d John Rawlins to compleate y.e s.d Conveyance to y.e Complt And forasmuch as y.e s.d John Rawlins by his Letter directed to y.e Regist.r of his Hon.ble Court here in Court produced & dated August y.e 13.th 1695 has declared y.t he owns y.e s.d 300 acres to have been bought from his Father John Rawlins decd by y.e Complt & y.t he is content y.t a Decree of this Hon.ble Court shall pass y.t y.e s.d John Anderson may have y.e s.d land to him & his heirs forever This Hon.ble Court upon hearing y.e whole matter in y.e bill & Letter afd contained this 19.th day of August 1695 do order adjudg & decree y.t y.e s.d John Rawlins shall execute to y.e s.d John Anderson such Deed & Conveyance of y.e s.d 300 acres of land of y.e Councill of y.e s.d Complt shall devise or direct for y.e confirming y.e same to him & his heirs forever with generall Warranty And in y.e mean time y.e said Complt to hold & enjoy y.e s.d land free from all Incumbrances whatsoever to him & his heirs forever according to y.e Originall Contract made between the said Complt & y.e Father of y.e s.d John Rawlins decd as in y.e bill is mentioned signed loc Hen Jowles Chancell.r sigil Elias Nutwell ag.st Bill W.m Coursey Ordered y.t attachm.t issue ag.st y.e Defts for want of Answer & al Sam Manthorp Adm.r of Burman Bill ag.st Ordered y.t y.e Answer be filed by y.e 7.th of Sept.r next John Davies All other Causes Continued The Court adjourns till y.e 21.st Instant John Freeman Regist.r Aug.st |
