263 of Eighteen thousand pounds of tobacco part of the said Twenty nine thousand foure hundred And Eighty one pounds of tobacco And they did further award the Comp.lt to pay the Deft Eleaven thousand foure hundred eighty one pounds of tobacco Residue of the said Twenty nine thousand foure hundred eighty one pounds of tobacco Principall debt aforesaid in manner as hereafter is mentioned And they did allowe to the said Deft for Damages for forbearance of his Debt aforesaid (all Necessary allowances for pception of proffits & other allowances whatsoever deducted) Eight thousand five hundred and nineteene pounds of Tobacco W.ch with the Eleaven thousand foure hundred eighty one pounds of Tobacco aforesaid amounted to the sume of Twenty thousand pounds of Tobacco To be payd by the Comp.lt is the Deft in manner following That is to say Tenn thousand pounds part thereof upon the tenth day of December then next following And Tenn thousand pounds of tobacco Residue thereof Upon the foure and Twentyeth Day of December Annoq Dom 1681 To be payd convenient in Calvert County And untill & for Security of payment of the Said two Sumes of tenn thousand pounds of Tobacco and Tenn thousand pounds of tobacco they did Award that the first Deed of Morgage & Lease of the whole Land called Tillington Dated the 19.th July 1677 should stand and be in full force & vertue in the Lawe And they did further order that if it should Soe happen the said Joseph Tilley his heires Executo.rs or Adm.rs Should make Default of payment of the said Seaverall sumes of Tenn thousand Pounds of tobacco and tenn Thousand pounds of Tobacco at the Dayes and places aforesaid before Awarded to be payd That then and from thence forth the said deft his heires Exec.rs & Adm.rs should and doe quietly hold and Enjoy the said Mortgaged or Leased premisses or soe much thereof as was not before Awarded to the Deft against the said Complaynant barred of all Equity of Redemption as aforesaid And they did Order the Complaynant to pay the Costs of the Suite and the Decree to be thereupon made And upon the fifteenth day of May 1680 the said Report was by this Court Ordered to be ratified and confirmed by the Decree of this Court to be observed performed fulfilled and kept by both the said partyes to all intents and purposes according to the true intent and meaning thereof according to the said former order without any other or further motion appeale from the same or [illegible] thereof And that the said Comp.lt should pay unto the said Deft the costs of this Suite to be taxed by the secretary or Register of this Court Since wch time the said Decree hath beene Duely drawne up signed and Enrolled as by the same remaining upon Record appeared And y.e Defend.t hath procured his bill of costs to be taxed wch amounts to the sume of Twelve thousand six hundred fifty two pounds of tobacco by (the |
