The Lord Prop.ry ag.t Comand was given to the Sheriffe of Dorchester County John Hudson that Whereas John Tench of Liverpoole in the Kingdome of England Marchant by vertue of a Warrant to him granted Out of Our Secretaryes Office bearing Date the sixth day of Time Annoq Dom One thousand six hundred seaventy foure had Layd out for him a parcell of Land in Dorchester County in this Province of Maryland Called Johns Delight for Two hundred Acres & Certifficate of Survey thereof Returned unto the said Office bearing date the third day of September Following as appeares upon Record and Whereas John Hudson late of Dorchest.r County Planter deceased Attorney to the said John Tench intending fraudulently to deceive the said John Tench of the said Two hundred Acres of Land Did in the Absence of him the said John Tench Out of this Province Cause to be Entred upon Record in the said Province att the foot of the s.d Certifficate an Assignement from him the said John Hudson as Attorney of the said Jn.o Tench of the said Certifficate w.th all the Lands therein Mentioned to his Two sonns Thomas and Joseph Hudson & Caused Pattent thereupon to be Drawne for the said Two hundred Acres in the name of the said Thomas & Joseph w.thout the Consent Privity or Knowledge of him the said John Tench By reason whereof the said John Tench is in Danger of being defrauded of the same haveing noe Remedy att Comon Lawe as by the greivous Complaint of the said John Tench to Us & our Counsell hath been sett forth and hath therefore humbly prayed Our writt of scire facias to be directed to John Hudson the Younger sonn of the said John Hudson the elder the p.rsent posses.r of the said Two hundred Acres of Land to shew Cause why the said Pattent for the same being in manner & forme as aforesaid surreptitiously obtained should not be surrendered up to be Vacated Upon Record Itt was therefore Comanded the said sheriffe That by good and Lawfull men of his baliwick hee make Knowne unto the said John Hudson the Younger That hee bee and appeare before his Lopp the Right Hono.ble the Lord Proprietary in his Court of Chancery the seaventeenth day of February in the Fifth yeare of his said Lopps Dominion &c.a Annoq Dom 1680 wheresoever it should then be To shew Cause (if any hee have) why the Pattent soe surreptitiously obtained as aforesaid Ought not to be Vacated adnulled and made Voyd Upon Record and further to doe and receive what the said Court should Consid.r of in that behalfe and how hee should Execute that p.rcept that hee make Knowne to the said Court at the day aforesaid On w.ch said Fifteenth day of February aforesaid Stephen Gary Sheriffe of the County aforesaid made returne of the writ aforesaid That hee had made Knowne to John Hudson the Younger the nineteenth day of January 1680 in the presence and before Thomas Hicks & John Cawsey both Freemen of his Baliwick (Afterwards |
