(216 And pay him his Just Dues Either in Tobacco or by Ratifyeing and Confirmeing the said Sale and Conveyance of the said Six hundred acres of Land to the said Deft and his heires for ever for the true Vallue thereof and by Giveing New forme and good bills of Sale for the goods plate servants Cattle Houshold stuffe and other things then in his Custody Provided the Comp.lt might have all his aforesaid bills bonds specialtyes and Mortgages Delivered him in from the deft and Legall Discharges thereupon w.ch the Deft did altogether refuse to Doe but did affright and deterr all psons from haveing any Dealeing w.th the Comp.lt p.rtending all the Comp.lts Reall and Psonall estate belonged to him the said Deft soe that Noe pson would have any Dealeing w.th the Comp.lt for any of the Comp.lts Reall or psonall Estate And the said deft Did Daily threaten the Comp.lt to take the said Reall and Remaind.r of the said psonall estate from the Comp.lt and posesse himself therew.th to the Ruine of the Comp.lt All w.ch Doeings were Contrary to Equity and good Contience Therefore to have the deft in his answere hereunto sett forth the pticulers aforesaid Upon his oath and what Tobacco hee Did in the yeare 1676 or att any Time since Disburse Expended & pay for the Comp.lt and to whome & for what and what hee had Received of the Comp.lts Tobacco and what sepcialtyes hee hath in his posession w.ch were paid w.th the Comp.lts Tobacco and whether the Term thousand Nine hundred ninety and eight pounds of Tobacco the Consid.racon of the Mortgage of the psonall Estate were not all was then due to him and whether hee did not Receive of the Comp.lt in pt of the discharge of that Mortgage the sume of Nine thousand Two hundred and fourteene pounds of Tobacco and what goods Cattle plate servants houshold stuffe and other things hee had received sold & Converted to his owne use and whether the Account made upp the one & twentieth day of May wherein hee brings the Comp.lt Debt.r to him the sume of Twenty five thousand Eighty and Eight pounds of Tobacco being the Consid.racon of the Mortgage of the whole Reall estate was not aswell to Discharge all the bills Bonds specialtyes Disbursments & payments that the said Deft payd or any wayes brought the Comp.lt in Debt for as in Discharge of all such Tobacco as Remaines unpaid upon the Mortgage of the personall Estate and whether the same security were Not for one and the same Debt both of the Reall & psonall Estate & |
