(188 on Marriage w.th his wife settled on her or Trustees for her by Judgment or Recognizance sixty thousand pounds of Tobacco w.ch would take place of a bond being done in Consideration of Marriage and the said Garret haveing beene much afflicted w.th the Gripeing of the Gutts and was more like to Dye then to Live all w.ch made his Credito.rs Come soe feircely upon him That the Comp.lt left a Considerable sume of Tobacco in the Province and his Kinsman John Deery his Attorney and w.th him left all his bills bond & writeings and accompts hopeing the said John Deery would have paid his debts and have Received a Considerable sume of Tobacco to have loaded on board the said shipp but found Deery dead and his Concernes Neglected & the Comp.lt disaponted of Tobacco to Load the said shipp and his pson and Goods like to bee sued & taken in Execution That the Deft impart of pay for the said Twenty Eight thousand Eight hundred and Eighty pounds of Tobacco due to bee payd the Comp.lt upon the 28.th day of october 1677 had drawne a Noate on Coll Vincent Lowe then high sheriffe of Talbott County for Fifteene thousand one hundred and Twenty pounds of Tobacco Payable to Derry the Comp.lts Attorney and Deery upon Creditt of that Noate upon the sixteenth day of Novemb.r drew a Noate on Coll Lowe for Tenn thousand pounds of tobacco to bee paid Thomas Matthews in Virginia but Coll Lowe refused to accept of it or pay the same Whereupon Matthews sued the Comp.lt and the Complt to p.rsent Execution was forced to pay him in goods and sarvants at a Low rate to his greate dammage and the said Deery being dead and not haveing Rec.d one pound of the said Twenty Eight thousand Eight hundred and Eighty pounds of Tobacco Nor one pound of the said Twenty five thousand seaven hundred and fifty pounds of Tobacco to bee paid the said Tenth day of octob.r for the said Provisions the Defend.t administred the said Deerys Estate And the Judge for Probate of wills and Granting Administrations being informed that the said Deery had in his Custody Seaverall bills bonds and Papers belonging to the Comp.lt Amounting to the sume of Three hundred thousand pounds of Tobacco & in pticuler the said Two bonds of the said Defend.ts The said Judge caused the same to bee secured in a Chest locked and Delivered the Key thereof to one Edmond Dermott for the Comp.lts use till the Comp.lt Came into the Province That the Comp.lt being Arrived Could not get his papers and writeings and in pticuler the said defts two bonds till the middle of June That the Comp.lt at his Arrivall did Acquainte the defend.t that hee had brought in all the Provisions hee was bound to Deliver and that hee was then Ready to deliver the same but desired to Know where the def.t would ord.r him his Tobacco according to the said bond The Deft told the Comp.lt hee had noe Tobacco left but that if the Comp.lt would stay till another yeare hee would pay the Comp.lt but the Comp.lt told him hee Expected psent pay w.ch the said Deft said hee Could not doe and soe desired the Comp.lt to spare him for his owne use a hhd or Two of Malt and some small Quantity of the rest of y.e Provisions at the same (rate |
