(175) according as the said Refferrees shall order and Award freed & Cleared from the seaverall Mortgages in the bill menconed But if the said Comp.lt doe not pay the Tobacco that by the account hereafter to bee made before you the said Refferrees shall appeare to bee due and shall bee by the said Refferrees found to bee due to the said Def.t and adjudged to bee paid to him the said Defend.t by the sd Comp.lt by such day or time as the said Refferrees shall limitt & appointe Then Itt is hereby alsoe ordered & Decreed that the said Defend.t shall hold and Enjoy the said Mortgaged Lands and premisses goods & Chattells in the said bill mentioned or such and soe much thereof as the said Refferrees shall in theire Judgment thinke fitt & soe order & Award to him and his heires and assignes For Ever Freed and Discharged of all Equity of Redempcon And the said Refferrees are From day to day dilligently to attend the ending & Finally Determineing the matters aforesaid And what order Doome Judgm.t Award or other Finalll determinacon shall bee made by the said Refferrees Is hereby Ordered and Decreed to stand Ratified and Confirmed to all intents & purposes to bee observed & pformed by both pties according to the true meaning thereof w.thout Further motion or Appeale From the same or Repeale thereof Charles absolute Lord and propprietary of the provinces of Maryland & Avalon Lord Baron of Baltemore &c To our Trusty and well beloved Leiu.t Collon.ll Henry Darnall and Collon.ll Henry Jowles greeting whereas a Final order and Decreed was made in our high Court of Chancery w.ch followes in these words viz Att a Court of Chancery held att the Citty of S.t Maryes the fourteenth day of October in the fourth yeare of the Dominion of the Right hono.ble Charles L.d Baltemore &c Annoq Domini One thousand six hundred seaventy nine then present the Hono.ble Philip Calvert Esq.r Chancello.r the hono.ble Vincent Lowe Esq.r Surveyo.r Gen.ll the Hono.ble Leu.tt Coll Henry Darnall Esq.r and the hono.ble Collon.ll William Stevens Esq.r whereas Thomas Bland and Damoras his wife Exhibitted theire Bill of Complaynt the thirteenth day of June 1679 ag.t Edward Dorsey and Sarah his wife and others in the high and hono.ble Court of Chancery of this Province thereby setting forth that the said Damoras one of the Comp.lts was the Relict and Executrix of Nicholas Wyatt of the County of Ann Arrundell deceased, that the Def.t Dorsey writt the Inventory amounting to one hundred forty five thousand foure hundred Twenty nine pounds of tobacco and Inserted therein more goods then belonged to Wyatt, that Damoras intrusted Dorsey w.th Wyatts Estate dureing her Ex.rx p p who in that time Converted much of the said Wyatts goods to his owne use That Dorsey Caused the said will to bee pronounced voyd the fifth day of September 1676 tooke out L.rs of Adm.con in his owne name and Exhitted an Inventory amounting to Eighty thousand pounds of Tobacco (and |
