SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:
Article 48A - Insurance Code
527.
In addition to the powers and duties enumerated in other
sections of this subtitle,
(10) The contractual obligations of the impaired
insurer for which the Association becomes or may become liable
shall be as great as, but no greater than, the contractual
obligations of the impaired insurer would have been in the
absence of an impairment unless such obligations are reduced as
permitted by subsection (5) AND UNDER NO CIRCUMSTANCES SHALL THE
ASSOCIATION BE LIABLE FOR CARE RECEIVED AFTER THE DATE OF AN
INSURER'S IMPAIRMENT UNLESS SUCH CARE WAS IN PROGRESS ON SAID
DATE OR UNLESS OTHER HEALTH CARE COVERAGE IS NOT AVAILABLE FROM
ANOTHER INSURANCE COMPANY OR NONPROFIT HEALTH SERVICE PLAN.
(12) THE ASSOCIATION HAS THE SOLE POWER TO APPOINT A
LIQUIDATOR, REHABILITATOR, CONSERVATOR, OR ANCILLARY RECEIVER FOR
ANY LIQUIDATION OR REHABILITATION PROCEEDING INVOLVING A DOMESTIC
OR FOREIGN OR ALIEN INSURER. THE LIQUIDATOR, REHABILITATOR, OR
CONSERVATOR OF ANY IMPAIRED INSURER MAY NOTIFY ALL INTERESTED
PERSONS OF THE EFFECT OF THIS SUBTITLE:

The Association may recommend a natural person to serve as a
special deputy to act for the Commissioner and under his
supervision in the liquidation, rehabilitation, or conservation
of any member insurer.]
SECTION 2. AND BE IT FURTHER ENACTED, That Section(s) 533
through 580, respectively, of Article 48A - Insurance Code, of
the Annotated Code of Maryland be renumbered to be Section(s) 532
through 579, respectively the Life and Health Insurance Guaranty
