AN ACT concerning
Procurement - Resident Business Preference
FOR the purpose of requiring each State agency to accept certain
bids from Maryland firms over bids from nonresident firms
under certain circumstances providing for a preference to a
Maryland firm in the award of a certain competitive bidding
contract by State agencies under certain circumstances;
repealing certain provisions of law relating to preference;
providing that a State agency awarding a contract by
competitive bidding shall__give a certain preference to
Maryland firms under certain circumstances; repealing a
provision relating to preferences for supplies manufactured
in Maryland; and generally relating to preferences for
Maryland firms.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:
Article 21 - Procurement
8-301.
[(a) In purchasing supplies for the using agencies the
Secretary of General Services shall give a preference to supplies
manufactured or produced in Maryland, except when in the judgment
of the Secretary such purchases would operate to the disadvantage
of the State.
(b) (1) In this subsection, "Maryland firm" means a
business entity which has its principal office in this State.
(2) When awarding a construction contract based on
competitive bidding, the Department of General Services shall
accept the lowest responsive and responsible bid from a Maryland
firm over that of a bid from a resident of another state if:
(i) That state gives any preference to resident
firms over Maryland firms; and
