SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall be applicable for all taxable years beginning after
December 31, 1981.

Act shall take effect July 1, 1982.

AN ACT concerning

Public Defender - Payment of Attorney's Fee

FOR the purpose of requiring the court to order the payment
of an attorney's fee on behalf of the Public Defender
under certain circumstances.

BY repealing and reenacting, with amendments,

Article 27A - Public Defender

Section 7(g)

Annotated Code of Maryland

(1976 Replacement Volume and 1981 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
read(s) as follows:

Article 27A - Public Defender

7.

(g) A court exercising criminal jurisdiction [may]
SHALL order a defendant to reimburse the State for services
rendered to the defendant by the Public Defender as a term
or condition of any sentence, judgment, or [stay of judgment
entered under § 641(a) or § 292 of Article 27 of the Code]
PROBATION imposed by it [if] UNLESS the court AFFIRMATIVELY
finds that the defendant [has] DOES NOT HAVE the ability to
make such reimbursement AND WAIVES THE TERM OR CONDITION.
The amount, time, and method of payment shall be established
by the court. In all other cases of reimbursement for
services rendered, collection shall be made in accordance
with subsection (f).
