Ch. 281

Department of Transportation that the General Assembly
has stricken or reduced; and providing a certain
exception.

BY repealing and reenacting, with amendments,

Article - Transportation
Section 3-216(d)(2)
Annotated Code of Maryland
(1977 Volume and 1981 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
read(s) as follows:

Article - Transportation

3-216.

(d) (2) Expenditures under this subsection shall be
made in accordance with any appropriation provided for in
any applicable budget bill or supplementary appropriation
bill. However, an appropriation proposed to be made to any
unit in the Department or proposed to be made for any
designated transportation activity, function, or undertaking
that has been reduced by the General Assembly may not be
restored, for the same purpose as originally proposed,
EXCEPT IN AN EMERGENCY, by the budget amendment procedure of
Article 15A, § 8(e) of the Code, unless the General Assembly

in striking or reducing the appropriation, expressly

authorized its restoration via the provisions of Article
15A, Section 8(e) OR OTHERWISE IF THE GENERAL ASSEMBLY IN
STRIKING OR REDUCING THE APPROPRIATION, PROHIBITED ITS
RESTORATION. THE BUDGET AMENDMENT PROCEDURE OF ARTICLE 15A,
§ 8(E) OF THE CODE MAY NOT BE USED TO EXPAND THE LEVEL OF
DEPARTMENT PROGRAMS OR SERVICES ABOVE THE LEVEL APPROVED BY
THE GENERAL ASSEMBLY OR TO ADD NEW DEPARTMENT SERVICES OR
PROGRAMS EXCEPT FOR EMERGENCY PROJECTS. HOWEVER, EXCEPT FOR
EMERGENCY CAPITAL PROJECTS, IF THE GENERAL - ASSEMBLY
EXPLICITLY REDUCES IN THE BUDGET BILL AN APPROPRIATION
PROPOSED FOR A MAJOR CAPITAL PROJECT AS DEFINED IN §
2-103.1(A)(3) OF THE TRANSPORTATION ARTICLE, THE
APPROPRIATION MAY NOT BE RESTORED FOR THE SAME PURPOSE AS
ORIGINALLY PROPOSED BY THE BUDGET AMENDMENT PROCEDURE OF
ARTICLE 15A, § 8(E) OF THE CODE OR OTHERWISE UNLESS THE
GENERAL ASSEMBLY, IN STRIKING OR REDUCING THE APPROPRIATION,
EXPRESSLY AUTHORIZED ITS RESTORATION.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1982.
