2584                                  LAWS OF MARYLAND                                Ch. 279

SECTION 2 3.. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1982. is hereby declared to be an
emergency measure and necessary for the immediate
preservation of the public health and safety and having been
passed by a yea and nay vote supported by three-fifths of
all the members elected to each of the two Houses of the
General Assembly, the same shall take effect from the date
of its passage.

(Senate Bill 570)

AN ACT concerning

Office on Aging - Continuing Care Contracts and Services

FOR the purpose of altering certain definitions in the
provisions of law relating to the regulation, by the
Office on Aging, of continuing care contracts and
services; and generally relating to continuing care
contracts and services.

BY repealing and reenacting, with amendments,

Article 70B - Office on Aging

Section 7(b) and (d)

Annotated Code of Maryland

(1978 Replacement Volume and 1981 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
read(s) as follows:

Article 70B - Office on Aging

7.

(b) ["Continuing care" means furnishing, for money or
other consideration, care and shelter to - an individual 60
years of age or older not related by consanguinity or
affinity to the provider under an agreement which:

(1)  Requires 12 or more months' care to be paid
for in advance or at one. time, or the payment of a sum that
represents the estimated value of 12 or more' months' care
notwithstanding periodic charges;

(2)  Provides for extended care over a period of
1 year or more; or
