5-107. ADDITIONS TO SCHEDULE OF CONTROLLED POISONS.

(A)  ADDITIONS BY BOARD.

IF THE BOARD FINDS THAT IT IS NECESSARY FOR THE
PROTECTION OF THE PUBLIC, THE BOARD SHALL ADD TO THE
SCHEDULE OF CONTROLLED POISONS ANY POISON THAT IS AS TOXIC
IN ITS EFFECT AS ANY OF THE CONTROLLED POISONS.

(B)  PUBLIC HEARING.

BEFORE THE BOARD MAY ADD ANY POISON TO THE SCHEDULE OF
CONTROLLED POISONS, THE BOARD SHALL HOLD A PUBLIC HEARING ON
THE PROPOSED ADDITION.

(C)  NOTICE.

(1)  AT LEAST 10 DAYS BEFORE THE PUBLIC HEARING,
THE BOARD SHALL PUBLISH NOTICE OF THE HEARING:

(I)   IN A DAILY NEWSPAPER OF GENERAL
CIRCULATION IN BALTIMORE CITY;

(II)  BY ISSUING A PRESS RELEASE, COPIES OF
WHICH SHALL BE MADE AVAILABLE AT THE OFFICE OF THE BOARD; OR

(III)  BY ANY OTHER MEANS THAT THE BOARD
CONSIDERS NECESSARY.

(2)  A NOTICE OF THE BOARD SHALL INCLUDE:

(I)  THE DATE, TIME, AND PLACE OF THE
HEARING; AND

(II)  THE NAMES OF THE SPECIFIC POISONS
THAT THE BOARD PROPOSES TO ADD TO THE SCHEDULE OF CONTROLLED
POISONS.

REVISOR'S NOTE: This section is new language derived
without substantive change from former Article
43, § 277(b) and (c) and the first clause of the
first sentence of (a).

The provision in former Article 43, § 277(c),
that related to the authority to continue or
adjourn a hearing is deleted as unnecessary.

The last sentence of former Article 43, §
277(c)(3), which provided that the Board has the
power to prescribe rules and regulations to
conduct its hearings, is deleted as unnecessary
in light of similar provisions in Article 41, §
245 of the Code.
