1-301. SECRETARY TO ENFORCE PROVISIONS OF ARTICLE.

THE SECRETARY SHALL CARRY OUT AND ENFORCE THE
PROVISIONS OF THIS ARTICLE AND THE RULES AND REGULATIONS
ADOPTED UNDER THIS ARTICLE.

REVISOR'S NOTE: This section is new language added to
avoid repetition in this article of phrases such
as "The Secretary shall enforce the provisions of
this subtitle and the rules and regulations
adopted under this subtitle".

As to the duty of the Secretary to enforce all of
the Department's rules and regulations and all
other provisions of law that relate to health,
see HG § 2-104(m).

TITLE 2. AMBIENT AIR QUALITY CONTROL.
SUBTITLE 1. DEFINITIONS; GENERAL PROVISIONS.
2-101. DEFINITIONS.

(A)  IN GENERAL.

IN THIS TITLE THE FOLLOWING WORDS HAVE THE MEANINGS
INDICATED.

REVISOR'S NOTE: This subsection is new language derived
without substantive change from the introductory
language of former Article 43, § 691.

In this subsection and throughout this title, the
word "title" is substituted for "subtitle" where
appropriate to reflect the organizational scheme
of this article.

(B)  AIR POLLUTION.

"AIR POLLUTION" MEANS THE PRESENCE IN THE OUTDOOR
ATMOSPHERE OF ANY SUBSTANCE THAT IS PRESENT IN SUCH
QUANTITIES AND IS OF SUCH DURATION THAT IT:

(1)  MAY BE PREDICTED WITH REASONABLE CERTAINTY
TO BE INJURIOUS TO PROPERTY OR TO HUMAN, PLANT, OR ANIMAL
LIFE; OR

(2)  UNREASONABLY INTERFERES WITH THE PROPER
ENJOYMENT OF THE PROPERTY OF OTHERS BY EMITTING AN ODOR, A
SOLID, A VAPOR, A LIQUID, OR A GAS BECAUSE OF THE EMISSION
OF ODORS, SOLIDS, VAPORS, LIQUIDS, OR GASES.
