Article 41 - Governor - Executive and Administrative

Section 409-I(b) and (e)
Annotated Code of Maryland
(1978 Replacement Volume and 1980 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article 41 - Governor - Executive and Administrative

Departments

409-I.

(b) (1) The Commission shall consist of nine members
appointed by the SECRETARY OF ECONOMIC AND COMMUNITY
DEVELOPMENT, WITH THE APPROVAL OF THE Governor, WITH THE
ADVICE AND CONSENT OF THE SENATE, a majority of whom shall
be members of the native American Indian communities of this
State. The members of the Commission shall have knowledge
of Indian culture and history, and be sensitive to the
problems of the Indian communities. The term of a member is
3 years except that, of the nine members appointed on July
1, 1979, three serve 1-year terms, three serve 2-year terms,
and three serve 3-year terms. At the end of a term, a
member continues to serve until a successor is appointed and
qualifies. A member who is appointed after a term has begun
serves only for the rest of the term and until a successor
is appointed and qualifies. A member may succeed himself,
but may not serve more than 6 years consecutively after July
1, 1979.

(2)  Members of the Commission shall receive no
compensation for their services [as such], but they may be
reimbursed for proper and necessary expenses incurred in the
discharge of their duties on the Commission in accordance
with the standard travel regulations.

(3)  The [Governor, from time to time, shall
designate] COMMISSIONERS SHALL ELECT ANNUALLY a chairman and
vice-chairman from among the members of the Commission.

(4)  The Commission shall meet at the call of
[either] the chairman, [or] a majority of the members, OR
THE SECRETARY OF ECONOMIC AND COMMUNITY DEVELOPMENT.

(e) [The Commission may appoint and determine the
compensation of personnel it deems necessary, subject to the
approval of the Board of Public Works or as provided for in
the budget.]

(1) THE COMMISSIONERS, SUBJECT TO THE APPROVAL
OF THE SECRETARY OF ECONOMIC AND COMMUNITY DEVELOPMENT,
SHALL APPOINT, FROM WITHOUT THEIR NUMBER, AN ADMINISTRATOR
OF THE COMMISSION ON INDIAN AFFAIRS.
