Aprill Court 1702 to the Said Plaintf. for the Sume of Ten pounds Sterg as in Said plfs Decln is Set forth. But the Said Defendt. further by protestation Sayth that the Said Obligation was Sealed and delivered to Said plaintfs by Said Defdt Conditionally that is to Say if Said Plaintf. and A Certain Joseph Crouch Met According to An Appointment made by Said Plaintf. And Said Defendt. At the house of Edward Fry on Chester River and there did by their Strength Skill and agility in wrestling or Endeavouring to throw or heave Each other and that it Should So happen that the Said Plaintf. Should oversett or throw Down farely the Said Crouch three times (according to the rules in Such Tryalls used) before the Said Crouch Should Serve the opposite prty in like Maner that then and in Consideration thereof the said Defendt. was to for= =feit and pay the Sume of ten pounds afd And further the Said Deft. in fact Sayth that they the Said Plaintf. and Said Crouch did not meet And Wrestle Neither did the Said plaintif ever heave or over Sett the Said Crouch three times according to the afd wager or appointment of meeting to wrestle And therefore the plaintf Against the Said Deft. this accon ought not to have or maintain All which he is ready to Aver, And of this he puts himself upon the Country ~ Earle pro dece And the Plaintif in Manner Macklin pr qr Whereupon Comand is given the Sherf of Kent County that he Immediately Cause to Come here twelve &ca. by whom &ca. who neither &ca. because as well &ca. of which Sd precept the Sherf Makes retn. that he has here ready twelve &ca. As by his precept he was Comanded to wit Thomas Covington Wm. Robinson ~ Henr Hynson Jno. Haymer Jno. Tylliard Richard Mason Charles Hollins= worth Samuel Tovy Robert Parks Robert Peark Henr Willcocks Patrick Obryan Who being Elected Tryed and Sworn to Say ye. Truth in the prmises and And Allegacons on both Sides do Say upon their oaths we of the Jury find for the Defendt. // Which being by the Court heard and understood It is by them Considered this Seventh day of Aprill afd That the Said Richd: Morris take Nothing by his bill afd but in Mercy for his false Clamour And that As to the Writt afd the Sd Alexander Graves go thereof without day. And it likewise Considered by the Justices here the Same day and year that the Said Alexander Graves Recover agt. the Said Richard Morris the Sume of Eight hundred and fifteen ~ ~ ~ pounds of tobacco for his Costs of Suit in this behalf layd out And Expended ~ |
