      And whereupon the Said Michael Earle in his prpr prson in prsecution of ye accõn afsd
      Saith yt whereas ye Said Edward in his life time to witt on ye twentÿ first daÿ of Febÿ anno
      Dñi 1701 in Kent Countÿ Countÿ aforesaid wthin ye Jurisdiction of this Court bÿ his
      Certaine bill or writing obligatorÿ Sealed wth: his Seal as his act & Delivered & here in
      Court brought whose Date is ye Same Daÿ & year Did bind himselfe his heirs, Exrs, admrs
      to paÿ or Cause to be paÿd unto ye aforesaid Michael his heirs Exrs: admrs: Certaine ~
      attrÿ or assignes ye aforesd Sume of 3142ls of tobacco quallified as aforesaid Convent:
      in Chester River in Said Countÿ upon Demand after ye Date of ye Same bill; Yett not=
      wth.standing ye Said Edward in his lifetime ye aforesaid Sume of 3142ls of tobo unto ye Sd
      Michael Earle he Did not paÿ although often Demanded Neither hath the Said |GLumleÿ
   Since the Death of ye Said Edward ) to whom letters testamtrÿ in Due form of Law hath
      been Cõmitted &ca: ) although thereunto paid ye Same allthough thereunto required, but
      the Same to paÿ he hath Denÿed & refused & Still Doth Denÿ &: refuse & unjustlÿ
      Detaine to ye Damãge of ye Said Michael 6000ls of Tobo & thereupon he brings this

        And the Said Defend | as Exr of Edward ffreÿ ) Comes into Court and Sayeth
        that he Can not Gainsaÿ ye pltf’s accõn so as aforesaid agt him brought nor but
        that, the Said Edward ffrÿ was, & is, & stands justlÿ Indebted unto ye Said pltf ~
        in ye Sume aforesaid; as allsoe, ye Defent as Exr of ye Said Edward, as ~
        aforesaid and is therefore Willing that Judgm be Intrd &ca: as allsoe ye
                Said Deft be | accõrding to law ) recovered of [illegible] the Said Exn; when assets to paÿ
                the Same
        Which being | bÿ the Court ) heard & understood It is bÿ them Considered
        this twentÿ fourth Daÿ of August in the Second year of her majesties ~
        Reigne Annoq Dñi 1703 that the Said Michael Earle pltf recover agt

        the Said George Lumley ^ (as being Exr of Edward ffreÿ as aforesaid ) the
