exclusively within the Department of Natural Resources
and the Department of Health and Mental Hygiene;
limiting the authority of the Department of Health and

Mental Hygiene in this regard; continuing supervision

of proposed well-drilling by the Department of Health
and Mental Hygiene as to possible prejudice to health
and for notification when determined to the Department
of Natural Resources; providing for comment by the
Maryland State Board of Well Drillers of all rules and
regulations proposed for adoption by the Department of

Health and Mental Hygiene Natural Resources; and

clarifying and correcting language.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article — Natural Resources

8-602.

(a) [The] EXCEPT AS OTHERWISE PROVIDED BY THIS

SUBTITLE AND SUBJECT TO THE PROVISIONS OF § 1-104 (G) OF

THIS ARTICLE, THE Department may adopt any [necessary] rule
or regulation to further its general powers of supervision
over natural resources of the State, and for proper
conservation for public use, allocation, and development of
underground waters of the State. [The provisions of] Part
II of this subtitle [do] DOES not deny DENIES any State
municipality, county, or other political subdivision the
right to adopt and enforce any additional rule or regulation
RELATING TO PUBLIC POTABLE WATER SUPPLIES not inconsistent
with [the] THESE provisions [.], EXCEPT THAT THE CONSTRUCTION

OF WELLS, THE DEPARTMENT HAS THE EXCLUSIVE RIGHT TO ADOPT

RULES AND REGULATIONS WITH RESPECT TO THE APPROPRIATION OF
PUBLIC WATER, THE CONSTRUCTION OF WELLS OF NATURAL RESOURCES
AND THE DEPARTMENT OF HEALTH AND MENTAL HYGIENE SHALL

JOINTLY ADOPT A SINGLE SET OF REGULATIONS ON THE

CONSTRUCTION OF WELLS. THE REGULATIONS SHALL BE EFFECTIVE

JANUARY 1, 1979, AND THE PREVENTION OF THEIR CONSTRUCTION IF

THE DEPARTMENT OF HEALTH AND MENTAL HYGIENE DETERMINES THAT
