earthquake, flood, or other similar emergency, or in a
position that, under the laws of this State, is designated a
major nontenured policymaking or advisory position or a
policymaking or advisory position that ordinarily does not
require more than 8 hours per week;
F. Service in a facility conducted
for the purpose of carrying cut a program or rehabilitation
for individuals whose earning capacity is impaired by age or
physical or mental deficiency or injury or providing
remunerative work for individuals who because of their
impaired physical or mental capacity cannot be readily
absorbed in the competitive labor market by an individual
receiving such rehabilitation or remunerative work; however,
employment does include services rendered by the unsighted
or other severely handicapped employees of the Maryland
Workshop for the Blind;
G. Service as part of an
unemployment work-relief or work—training program assisted
or financed in whole or in part by any federal agency or an
agency of a state or political subdivision of a state, by an
individual receiving that work relief or work training; or
H. Service before January 1, 1978
for a hospital in a state prison or other state correctional
institution by an innate of the prison or correctional
institution and service PERFORMED after December 31, 1977 by
an innate of a custodial or penal institution FOR A
NONPROFIT ORGANIZATION OR GOVERNMENTAL ENTITY.
(vi) "Employment" includes agricultural
labor, as defined in subsection (w) of this section,
performed after December 31, 1977 if the labor is performed
for a person who:
[a] A. During any calendar quarter of
the current or preceding calendar year, pays cash
remuneration of $20,000 or more to individuals performing
agricultural labor; or
[b] B. On a portion of a day in each
of 20 consecutive or nonconsecutive weeks during the current
or preceding calendar year, employs at least ten individuals
in agricultural labor, regardless of whether or not the
individuals were employed at the same moment in time.
[c] C. For THE purposes of this item,
if the person TO WHOM AGRICULTURAL WORKERS ARE FURNISHED is
an employer, as defined in paragraph (2) of subsection (f),
any cash remuneration that the crew leader paid to the
individuals performing agricultural labor shall be treated
as cash remuneration paid by the employer.
(u) (2) "Educational institution" [does not
include] INCLUDES an institution of higher education, as
defined in subsection(s) of this section.
