Water Resources Administration.

BY repealing and reenacting, with amendments,

Article - Natural Resources
Section 8-1413(c)
Annotated Code of Maryland
(1974 Volume and 1977 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article - Natural Resources

8-1413.

(C) [After] UPON THE SERVING OF ADEQUATE public
notice, AS HEREIN PROVIDED PROVIDED IN THIS SUBSECTION, and
AFTER PROVIDING THE opportunity for public hearing AND
INFORMATION MEETINGS, the administration may issue a permit
for the discharge of any pollutant or combination of
pollutants into the waters of the State if the discharge
meets or will meet all applicable State and federal water
quality standards and effluent limitations and all other
requirements of this title. THE ADMINISTRATION SHALL HAVE
GIVEN INSURE THAT ADEQUATE PUBLIC NOTICE IS GIVEN BY:

(1) INSERTING AN APPROPRIATE NOTICE FOR__NOT

LESS THAN ONE BUSINESS DAY AT LEAST 30 DAYS IN ADVANCE OF

THE SCHEDULED DATE IN A NEWSPAPER OF GENERAL CIRCULATION IN
THE COUNTY IN WHICH THE FACILITY FOR WHICH A PERMIT IS
SOUGHT IS TO BE LOCATED.

(2) INSERTING SAID NOTICE FOR NOT LESS THAN

THREE BUSINESS DAYS AT LEAST FOUR WEEKS IN ADVANCE OF THE

SCHEDULED DATE OF THE HEARING.

(3) DEPOSITING APPROPRIATE DOCUMENTS, PERMIT

APPLICATIONS, SUPPORTING MATERIAL, PLANS, AND INFORMATION AT

A PUBLICLY ACCESSIBLE LOCATION WITHIN THE COUNTY IN WHICH

THE FACILITY FOR WHICH A PERMIT IS SOUGHT IS TO BE LOCATED.

(4) SENDING COPIES OF SAID NOTICE OF PUBLIC

HEARING TO SUCH UNITS OF LOCAL GOVERNMENT AS HAVE

JURISDICTION OVER THE AREA IN WHICH THE FACILITY FOR WHICH A

PERMIT IS SOUGHT IS LOCATED.

(5) SENDING COPIES OF SAID NOTICE OF PUBLIC

HEARING TO SUCH APPROPRIATE COUNTIES AND LOCAL UNITS OF

GOVERNMENT AS MAY BE IMPACTED BY THE DISCHARGE OF POTENTIAL

POLLUTANTS INTO STATE WATERS AS WELL AS THE SUBSEQUENT

NATURAL ACTIONS OF THESE WATERS AND THEIR TRUBUTARIES.

(2) PROVIDING APPROPRIATE NOTICE OF THE

APPLICATION__FOR A DISCHARGE PERMIT WITHIN 30 DAYS AFTER

RECEIPT OF THE APPLICATION;
