Article - Natural Resources Section 4-1014 Annotated Code of Maryland (1974 Volume and 1976 Supplement)
SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Sections 4-1004, 4-1012, and 4-1013 (a) and
(b) of Article — Natural Resources, of the Annotated Code
of Maryland (1974 Volume and 1976 Supplement) be and they
are hereby repealed and reenacted, with amendments, to
read as follows:
Article - Natural Resources
4-1004. (a)    A person may not catch oysters or clams for
commercial purposes in the waters of the State unless he
first obtains a license. A person may catch up to 1
bushel each of oysters and clams a day for his own use
and consumption without a license, in places and at times
prescribed by rule or regulation of the Department. The
licensing requirements of this subsection do not apply to
a person catching [oysters or] clams commercially by
[dredge, handscrape, or] hydraulic dredge that is
licensed pursuant to subsection (c). (b)    A person who has been a resident of the State
for 12 months immediately preceding his application for a
license may obtain a license to catch oysters or clams in
the waters of the State.
(c) [The types of licenses to catch oysters or
clams for commercial purposes by the means enumerated in
this subtitle and the license fees are the following:
$25 for each person
tonging or employed
on a tong boat $15 for each person
operating tongs or
rake or employed on
a tong boat $50 for each person
tonging or employed
a patent tong boat,
on which license
shall also allow
(1) Shaft or hand tongs
to catch oysters
(2) Shaft or hand tongs,
or rakes to catch
clams
(3) Patent tongs to catch oysters, or
diving apparatus
