BY repealing and reenacting, with amendments,
Article - Transportation
Section 8-408(a) and (b)
Annotated Code of Maryland
(As enacted by Chapter ____ of the Acts
of the General Assembly of 1977)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Sections 8-408 (a) and (b) of Article -
Transportation, of the Annotated Code of Maryland (As
enacted by Chapter ____ of the Acts of the General
Assembly of 1977) be and they are hereby repealed and
reenacted, with amendments, to read as follows:
Article - Transportation
8-40 8.
(a) Highway user revenues distributed to Baltimore
City AND KENT COUNTY may be used only to pay or finance:
(1) costs incurred in the construction,
reconstruction, or maintenance of its highways and
streets;
(2) costs incurred by [the] ITS police
department [of the city] for carrying out traffic
functions and enforcing the traffic laws;
(3) costs incurred in ITS other highway
related activities [of the city] for:
(i) lighting the highways;
(ii) storm water drainage of the
highways; and
(iii) street cleaning, but not including
the cost of collection of garbage, trash, and refuse;
(4) the payment of ITS debt service on bonds
or other evidences of obligation [issued by or for
Baltimore City] for:
(i) the construction, reconstruction,
or maintenance of its highways and streets; and
(ii) any other OF ITS highway
activities [of the city], including lighting the highways
and providing storm water drainage; [or]
(5) the cost of transportation facilities,
as defined in §3—101 of this Article; OR
(6) AS TO KENT COUNTY, COSTS FOR:
