AN ACT concerning
Natural Resources — Coastal Facilities
Review Act Hazardous Substances
FOR the purpose of altering certain bonding requirements
prior to issuance of a permit for those engaged in
transportation and disposal of certain designated
dangerous hazardous substances.
BY repealing and reenacting, with amendments,

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section 8-1413.2(k)(7) of Article -
Natural Resources, of the Annotated Code of Maryland
(1974 Volume and 1976 Supplement) be and it is hereby
repealed and reenacted, with amendments, to read as
follows:
Article — Natural Resources
8-1413.2.
(k) As a condition to the issuance of a permit,
the Department may require a permit holder to:
(7) [Maintain a surety bond in the name of
the State in an amount estimated by the Department to be
sufficient] FILE WITH THE DEPARTMENT ACCEPTABLE EVIDENCE
OF A BOND OR OTHER SECURITY DEEMED SUFFICIENT AND
ADEQUATE BY THE DEPARTMENT to cover any costs for:
(i) The monitoring, maintaining, and
closing of the facility;
(ii) The security of the facility after
its closure; and
(iii) Guaranteeing fulfillment of all
permit requirements; or

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1977.
|
