SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section 4.07(a) of Article 66B - Zoning
and Planning, of the Annotated Code of Maryland (1970
Replacement Volume and 1976 Supplement) be and it is
hereby repealed and reenacted, with amendments, to read
as follows:
Article 66B — Zoning and Planning
4.07.
(a) The local legislative body shall provide for
the appointment of a board of appeals.
The board of appeals [shall consist] CONSISTS of
three [(3)] or five [(5)] members. The terms of office
of the members of the board [shall be] ARE three years.
They shall be appointed by the local executive, confirmed
by the local legislative body, and removable for cause,
upon written charges, and after public hearing.
Vacancies shall be filled for the unexpired terms of any
member whose term becomes vacant. Members of the board
may receive such compensation as the local legislative
body deems appropriate.

SECTION 2. AND BE IT FURTHER ENACTED, That new
Section 4.07(b-1) be and it is hereby added to Article
66B — Zoning and Planning, of the Annotated Code of
Maryland (1970 Replacement Volume and 1976 Supplement) to
read as follows:
Article 66B - Zoning and Planning
4.07.
(B-1) NOTWITHSTANDING THE PROVISIONS OF SUBSECTION
(A) OF THIS SECTION, IN FREDERICK COUNTY, AFTER JULY 1,
1977, THE BOARD MEMBERS MAY BE APPOINTED TO STAGGERED
TERMS VARYING FROM ONE TO THREE YEARS.
