Ch. 566

A State Board of Registration for Professional
Engineers and Professional Land Surveyors is created as
part of the Department of Licensing and Regulation. It
shall administer the provisions of this article. The
Board shall consist of four professional engineers, a
professional land surveyor and a member of the general
public, all of whom shall be appointed by the Governor
with the advice of the Secretary of Licensing and
Regulation AND THE ADVICE AND CONSENT OF THE SENATE. The
[[engineers and the land surveyor member shall be
selected from lists of not [more] LESS than three
nominees recommended by]] engineers and the land surveyor
member shall be selected from lists of not [more] LESS
than three nominees recommended by [[GOVERNOR MAY
CONSIDER RECOMMENDATIONS FROM]] each of the following:
the Maryland chapter or section of the American Society
of Civil Engineers, the American Society of Mechanical
Engineers, the Institute of Electrical and Electronic
Engineers, the American Institute of Chemical Engineers,
and the Maryland Society of Surveyors[[, and]]. THE
ENGINEER AND LAND SURVEYOR MEMBERS shall have the
qualifications required by § 4. The Board shall consist
of one civil engineer, one mechanical engineer, one
electrical engineer, one chemical engineer, one land
surveyor, and the public member.

Each member of the Board shall receive a certificate
of his appointment from the Governor and before beginning
his term of office shall file with the Secretary of State
his written oath or affirmation for the faithful
discharge of his official duty. On the expiration of the
term of any member, the Governor, with the advice of the
Secretary [of Licensing and Regulation, ] AND THE ADVICE

AND CONSENT OF THE SENATE shall, in the manner

hereinbefore provided, appoint for a term of five years a
professional engineer, or a professional land surveyor,
having the qualifications required by § 4 or a member
from the general public, as the case may be. Each member
shall hold office until the expiration of the term for
which he is appointed or until a successor is duly
appointed and qualifies.

SECTION 2. AND BE IT FURTHER ENACTED, That if S.B.

_____ of 1976, removing land surveyors from the

jurisdiction of the State Board of Registration for
Professional Engineers and Professional Land Surveyors,
and creating a State Board of Registration for
Professional Land Surveyors is enacted, the provisions of
this Act shall be read together with the provisions of

S.B._____ in order to effectuate the intent of both Acts.

However, this Act is not contingent upon the passage of
S.B.

SECTION 3. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1976.
